By accessing or using Botreon.com (“Website”) or any services provided by the Company, including the creation, management and interaction with AI bots (“Bots” or “Characters”) via connected messaging applications (such as WhatsApp, Telegram, Instagram, Facebook Messenger, Discord, TikTok and others) (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, you must not use the Service. #### 1. Eligibility The Service is intended solely for individuals who are at least **18 years of age** or the age of majority in their jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this age requirement. **We do not verify age at registration.** You are solely responsible for ensuring your compliance with this requirement. If you are under 18, you must immediately cease using the Service. #### 2. Account Registration and Security You may need to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use. #### 3. The Service The Service allows users to create, customize and interact with AI-powered Bots. Interactions with Bots occur **outside the Website**, through third-party messaging applications and platforms. We provide the technical connection and AI backend, but we do not host or moderate conversations directly on our platform. You are solely responsible for complying with the terms of service and community guidelines of any third-party platforms you use (e.g., WhatsApp, Telegram, Discord, etc.). #### 4. Gems and Payments We offer the ability to purchase **Gems** with real money. Gems can be used to unlock additional features, such as faster responses and extended bot memory. All payments are processed through third-party payment providers. Purchases of Gems are **final and non-refundable** except as required by applicable law. We reserve the right to change prices, offerings, or suspend/refuse any transaction at our discretion. #### 5. Intellectual Property and Content Ownership * **User Content and Bots**: As between you and the Company, **you retain ownership** of all Bots (Characters), conversations, prompts, and other content you create or generate through the Service (“User Content”). * **Your Responsibility**: You are solely responsible and liable for all User Content you create or share. You represent and warrant that your User Content does not violate any laws or third-party rights. **License to the Company** By using the Service, you grant us a **worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable, perpetual and irrevocable** license to access, use, store, copy, modify, distribute, and otherwise exploit your User Content solely to the extent necessary to provide, maintain, improve, and promote the Service (including allowing other users to interact with your public Bots if you choose to make them public). You may choose to make your Bots public or private. We may, at our sole discretion, remove or block any Bot at any time without notice. #### 6. Acceptable Use Policy (Prohibited Conduct) You agree not to use the Service to create, promote, or engage in any of the following: * Any illegal activity under applicable laws; * Creation or distribution of deepfakes of real individuals without their explicit consent; * Pornography or sexual content involving real persons (including non-consensual intimate imagery); * Content that promotes, glorifies, or incites real-world violence, self-harm, or suicide; * Exploitation of minors or any content related to child sexual abuse material (CSAM) — **strictly prohibited**; * Hate speech, harassment, or discrimination based on protected characteristics. **Erotic roleplay and fictional adult content** between consenting adult characters (18+) is **permitted**, but you bear full responsibility for such content and any consequences arising from it. We reserve the right to investigate, block, or delete any Bot or User Content that we reasonably believe violates these rules, without prior notice. Repeated or serious violations may result in permanent suspension of your account. #### 7. AI Disclaimers and Limitation of Liability **The Bots are powered by artificial intelligence and may produce inaccurate, offensive, incomplete, or misleading responses.** You acknowledge and agree that: * The Service is provided “as is” and “as available” without any warranties of any kind. * We do not guarantee the accuracy, safety, or appropriateness of any Bot responses. * **You use the Service and any Bot responses entirely at your own risk.** **To the maximum extent permitted by law**, the Company, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. #### 8. Termination We may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. Upon termination, your right to use the Service ceases immediately. We are not obligated to return any Gems or refund any payments. #### 9. Changes to the Terms We may update these Terms from time to time. We will post the revised version on the Website with a new “Last Updated” date. Your continued use of the Service after the changes constitutes acceptance of the new Terms. #### 10. Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of the **United Arab Emirates**, without regard to conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of **Sharjah, United Arab Emirates**. #### 11. Miscellaneous * These Terms constitute the entire agreement between you and us. * If any provision is found invalid, the remaining provisions remain in full force. * Our failure to enforce any right does not constitute a waiver. * We may assign these Terms without your consent. **Contact Us** If you have any questions about these Terms, please contact us at:
